    BELOW ARE SUMMARIES OF RECENT TRIBUNAL ORDERS THAT HAVE DETERMINED A SIGNIFICANT MATTER SUCH AS THE STATUS OF A LICENSEE OR LICENSEE APPLICANT OR COSTS.

     

    Stephen George Reynolds, Lawyer (Ottawa)

    Mr. Reynolds engaged in professional misconduct by misappropriating approximately $158,000, practicing law while suspended, and failing to co-operate with a Law Society investigation. His licence is revoked, and he is ordered to pay $7,500 in costs to the Law Society.

     

    David Peter Ginzberg, Lawyer Applicant (Toronto)

    The panel orders that Mr. Ginzberg will pay $15,000 in costs to the Law Society.

     

    Harneet Kaur, Lawyer Applicant (Mississauga)

    Mr. Kaur does not meet the requirements for a licence, and so his licensing application is dismissed.

    The panel orders that no costs will be paid by either party.

     

    REASONS

    Alisa Mazo, Lawyer (Toronto)

    The Law Society alleged that Ms. Mazo “circled” funds between her trust and business accounts and allowed cheques to be deposited and issued without a belief that the deposited cheques would be honoured. This involved misconduct including failing to properly identify clients, allowing her trust accounts to be used for purposes unrelated to the provision of legal services, and failing to make reasonable efforts to ascertain the purpose of the retainer. The panel found that Ms. Mazo was wilfully blind or reckless regarding the transactions, misappropriated funds from her trust account, failed to keep books and records as required, allowed her trust account to be used for purposes unrelated to the provision of legal services, failed to properly identity clients or to ascertain the purpose of retainers, and failed to co-operate with the Law Society’s investigation. The panel determined that Ms. Mazo engaged in professional misconduct, and directed that a penalty hearing be scheduled.

     

    Deborah Anne Humphreys, Lawyer (Thunder Bay)

    Ms. Humphreys did not respond to the RTA and so was deemed to have admitted the facts set out. The panel found that Ms. Humphreys engaged in professional misconduct as alleged, including by transferring funds out of her trust account without authorization. Ms. Humphreys' licence was revoked and she was ordered to pay $10,000 in costs to the Law Society.

     

    Marilyn Jenny Monteiro, Paralegal (Toronto)

    Ms. Monteiro pleaded guilty to sending unwanted messages to a former client and other individuals associated with the client. She used knowledge gained from being the client’s representative to send the messages. The panel acknowledged extenuating and mitigating factors and accepted the joint submissions on penalty because it did not bring the administration of justice into disrepute and was not otherwise contrary to the public interest. Ms. Monteiro's licence was suspended for three months and she was ordered to pay $3,000 in costs to the Law Society.

    Glenn Patrick Bogue aka Spirit Warrior, Lawyer (Toronto)

    The application for termination of the suspension of Mr. Bogue's licence is permanently stayed. 

     

    Jesse Lee James Valkenier, Paralegal (Brockville)

    Mr. Valkenier engaged in professional misconduct by failing to co-operate with seven Law Society investigations and failing to comply with two Tribunal orders. His licence is revoked, and he is ordered to pay $6,674 in costs to the Law Society.

     

    REASONS

    William Francis Murray, Lawyer (Ottawa)

    The Tribunal had previously found that Mr. Murray failed to act with integrity in the handling of $2,000 provided by his client’s friend for bail, but that other allegations were not established. The panel ordered a reprimand and costs of $5,000.

     

    Eric Paul Polten, Lawyer (Toronto)

    Mr. Polten did not respond to the RTA and so was deemed to admit its contents. He did not attend the hearing, which proceeded in his absence. The panel found Mr. Polten engaged in professional misconduct, and accepted the Law Society’s submissions that he had refused and continued to refuse to co-operate with the Law Society as his regulator. The panel concluded that Mr. Polten was ungovernable and his licence was revoked. He was also ordered to pay $12,121 in costs to the Law Society.

     

    Richard Keith Watson, Lawyer (Toronto)

    Mr. Watson unsuccessfully moved to remove the Law Society’s representatives. Costs of motions where the issues are distinct from the merits of the application should be fixed at the time the motion is decided. The panel found that the motion was without merit and the amount sought by the Law Society for costs were excessive. Mr. Watson was therefore ordered to pay $15,000 in costs to the Law Society.

     

    Leona Editha Collantes Eilinger, Paralegal (Brampton)

    Ms. Eilinger admitted to providing legal services outside of the permitted scope of practice as well as sharing confidential client information on social media. After finding that Ms. Eilinger had engaged in professional misconduct, the panel accepted the joint submission on penalty and costs. A reprimand was ordered, along with costs of $2,000 to the Law Society.
